I also figured Harvey was dead, but Chance has me convinced otherwise right now. I sincerely doubt they will recast the Joker although they did leave it open for his return. Personally I think they completely finished filming before Heath Ledger died and had probably intended to include him in the sequel, if there is one. But now that Ledger is dead, I think they'll just leave the Joker out entirely. There's a pantheon of other Batman villains to choose from.

I'm pretty sure Batman is actually supposed to be the main character of this new Batman franchise, so seeing as though he's alive and kicking, the franchise can certainly continue. The main actors signed on for a 3 picture deal, and Gary Oldman insinuated there would be a third film (and that the Riddler would be included.) Trilogies are so popular these days, why not?
