Something to think about
Hey gang,
I just want to let you know that this post is not intended to sell anything to you guys or endorse a company/service. As a bookkeeper, I process alot of personal and business checks every single day. I noticed that some of the customers have the word "Trusts and Trustees" on their checks. I thought about it and I understand why it is important to look into this. Here's a little background story that all sounds familiar. My great grandma has four daughters. When she passed away, there was no will or trust to distribute her assets...antiques, jewelry and a house. All of the daughters got into an arguement on what they believe is theirs and they basically took what they can. This incident created some anger and mistrust among all of the relatives. This was about 2 decades ago. Here's another story: My sister's bf(AM) has a older brother(Late 40's) that married a very young AF(22) from China. She wants to get involved with her husband's family matters mainly control the possible sale of a house. When my sister's bf bought the house along with the other siblings, it was agreed that this was to ensure a good future for the siblings. So this AF wants to get her share when this was a pact made between the siblings. I met this AF and I am sorry but she has "bony" hands and she looks like a toothpick where you can just "blow her like a feather" and she will fall back. Plus she doesn't want to work and make a living. So that means if the husband passes away, she gets everything..plus she is going to possibly marry again for reasons not so good. How scary is that? It can happen both ways too where the husband can also do something not so good. Just something to think about along the way. |

That's why no matter how old you are, you should ALWAYS get a will drawn up. I am young and I did it. It's not something only rich people or people over 50 should do. I think as soon as you turn legal age and especially if you have assets that would be argued over, you should make a will. Why did I do it? Simple.. if I got into a car accident, a plane crash or got hit by a bus, then there would be no arguing. I even updated my will recently to include the ownership of ProAzn.com if something happened to me.
As for the girl that married that guy and wants to be the one to run the sell of the house, I have to be honest here about something. If this was a transaction with the family and she just married into it, I don't think she should be included in it. Sounds to me like she is a little bit of a gold-digger. Especially since she doesn't want to work to bring money into the household. Sounds like she is one to watch out for. But maybe that's just me..

Bottom line it's whoever's name is on the deed. If it's her husband and he doesn't change it legally no matter how much she bitches and wants in she won't get. End of story. Pro is right, it depends who is the beneficiary on the will under the executor. If she's not listed in the will or the deed of the house, tough luck to her. The house is safe. Marriage in itelf is not an automatic right of inheritance of a spouse. It's still has to be done in writing under a notary or lawyer.

When the deceased has many siblings and children its wise to draw up a will.
A trustee who is a family member may screw over people they dont like or because of selfish reasons unless they have specific instructions which again would be a will. proxy and trustee is dangerous stuff when there is property or money involved. |
